ELECTRONIC INVOICING IN PUBLIC PROCUREMENT
Electronic invoicing in public procurement has been compulsory since the beginning of 2019 and by the end of 2021 it will have to be implemented in all companies. However, for companies operating in the B2B and B2C sector, i.e. those outside public procurement, this issue also covers them. The legislation that makes electronic invoicing compulsory is based on European Union Directive 2014/55. It is this EU law that defines an electronic invoice as ‘an invoice that has been issued, transmitted and received in a structured electronic format that enables it to be processed automatically and electronically’. This means that scanning and emailing a manual invoice is not issuing an electronic invoice. An electronic invoice is an invoice like any other, but electronically signed using a qualified certificate.
IS ELECTRONIC INVOICING MANDATORY?

Public Procurement
Companies covered by public contracts, as well as public authorities and entities (direct State administration bodies and public institutes), according to Decree-Law No. 123/2018 , must have an EDI solution. Even so, national and European legislation provides for an exception: contracts declared confidential or accompanied by special security measures. B2B and B2C Electronic Invoicing
According to Decree-Law No. 28/2019, electronic invoicing covers all companies.They must guarantee the authenticity, integrity and non-repudiation of electronic invoices, whenever they are sent electronically, by means of a qualified electronic seal certificate. In short, all invoices sent to customers electronically can have an electronic seal associated with them. Without this qualified certificate, the documents sent will not be valid.
